(“Moodivation” and/or “Company”) in accordance with the Article 10 of the Law No. 6698 on the Protection of Personal Data (“KVKK”), and the Communiqué on the Procedures and Principles to be Complied with in Fulfilling the Obligation to Clarify (“Communiqué”), in addition to the General Data Protection Regulation (“GDPR”), in particular the Art. 13 (collectively, “Legislation”), to bring the following explanations to the attention of you, valued visitors, customers, and members, who are the employees of our customers. In this context, this Clarification Text on the Protection of Personal Data (“Clarification Text”) has been prepared only for informing website visitors, customers and members in accordance with the Legislation, and does not contain information regarding the processing of personal data of employees, employee candidates, suppliers and similar groups of persons.

Information about the personal data collected by the Company from and/or related persons, particularly, but not limited to, the Website and the mobile application named “Moodivation” (collectively, the “Platform”), and explanations regarding the processing activities of this personal data, and data information on the person responsible and the rights of the person concerned within the scope of the Legislation are stated in this clarification text.

Before using the Platform and using the services provided by the Company in general, you should read this Clarification Text.

All rights regarding all kinds of images, photographs, texts and similar content in all software, design and content of the Platform of the Company only belong to the Company and protected under intellectual and industrial property law.

Principles and Legal Reasons for the Processing of Your Personal Data

Moodivation is a digital platform that allows measuring the loyalty of company employees, reporting these measurements weekly and/or monthly, conducting surveys with employees, and providing feedback about the departments they work in. Moodivation provides services to its customers and its customers’ employees (“Members”) within the framework of the service agreement it has concluded with its customers, company officials (“Customer”).

The personal data of our Customers and Members can be processed in accordance with the Legislation to which we are subject, in connection with our field of activity and service purposes and in a measured manner, if necessary, they can be transferred to third parties and stored for periods in accordance with the Legislation.

Your personal data is processed and stored so that you can benefit from the services offered on the Platform.

Although your personal data may vary depending on the product and service offered by Moodivation; It can be collected verbally, in writing or electronically, by automatic or non-automatic methods, by various means, primarily the Platform.

In this context; Personal information such as your e-mail address, name, surname entered on the platform of Moodivation in order to benefit from the services offered by Moodivation; demographic information such as gender; Information we obtain from your use of the Platform; If you receive commercial electronic messages, information about their reading and other information provided by you in your comments and/or messages you write while using the Platform are collected and processed by Moodivation.

Purpose of Processing Personal Data

Your personal data is processed in accordance with the conditions specified in the legislation for carrying out the necessary studies so that you can easily and reliably benefit from the products and services offered by Moodivation, our products and services; customizing and recommending to meet your demands, needs and usage habits, conducting anonymous reporting processes, maintaining sales and marketing activities, fulfilling our Company’s legal obligations and ensuring that legal processes can be carried out quickly and effectively. In this context, your personal data is to identify and confirm the information of the person using the Platform, to identify problems and errors within the scope of the services offered, to collect, analyze and report the survey responses on the Platform, to evaluate and resolve the requests, complaints and suggestions of the users, to fulfill our rights and obligations arising from the current legislation processed for the purpose.

In addition to all these, personal data is processed for executing emergency management processes, executing activities in accordance with the legislation, executing financial and accounting works, following and executing legal affairs, executing communication activities, executing and auditing business activities, executing service procurement processes, executing service after-sales support services, executing service sales processes , executing service production and operation processes, executing customer relationship management processes, executing activities for customer satisfaction, organization and event management, conducting marketing analysis studies, executing performance evaluation processes, executing advertising and/or campaign and/or promotion processes, executing storage and archiving activities, executing contract processes, executing sponsorship activities, also for the purposes of following up requests and/or complaints, executing marketing processes, ensuring the security of data controller operations, executing investment processes, informing authorized persons, institutions and organizations, and conducting management activities.

Your sensitive personal data will not be processed by Moodivation without your express consent. To help prevent your personal information from being viewed by others, you must log in with your own credentials (e-mail address and password) and not share your identity and/or membership information with third parties. You can use the “View Profile” page to access and update your login information, access and/or view your personal data on Moodivation.

Personal Data Security

Moodivation acts in accordance with its obligations arising from the Legislation in establishing the necessary organization and taking and implementing technical measures in order to protect the confidentiality and integrity of personal data in accordance with the applicable Legislation. Your personal data will be collected within the scope of Moodivation’s field of activity and in line with the collection purposes, can be stored for the periods required by the purposes of processing and/or for the period stipulated in the applicable Legislation, and in the event that the reasons requiring it to be processed disappear, without prejudice to the cases that have a storage obligation arising from the current Legislation, ex officio or will be deleted, destroyed or anonymized upon your request as the person concerned.

Personal data is not stored by Moodivation for future use. The processing and storage of your personal data is carried out only by authorized and trained personnel and in areas where data security can be ensured.

It is your responsibility to keep the password used to access your account confidential. We would like to remind you that your username and password information should not be shared with anyone else.

Transferring Personal Data

As a procedure, within the scope of the rules specified in the Legislation and the purposes specified in this Clarification Text, Moodivation does not transfer your personal data to third parties without the express consent of the persons concerned.

In addition, by taking the necessary security measures in line with the purposes of personal data processing, personal data can be sent to third parties in the country and abroad, our business partners, our performance assistants, regulatory and supervisory institutions and official authorities in line with the purpose of our service and activity or in cases stipulated by the relevant legislation. It can be transferred and shared with the Company’s shareholders, Company employees, suppliers, business partners and consultants within the scope of the Legislation.

Your Rights Regarding Personal Data

Pursuant to the KVKK, you have the right to an opposing demand in cases where you are to learn whether your personal data has been processed, to request information if it has been processed, to learn the purpose of processing and whether it is used in accordance with its purpose, to learn the third parties to which it has been transferred in the country and abroad, to request correction if it is incomplete or incorrectly processed, for deletion or destruction within the framework of the conditions stipulated in Article 7 of the KVKK, to request the notification of the transactions made to the third parties to which it has been transferred, to object to the emergence of a result against you due to the analysis exclusively by automatic systems, and to repair the damage in case you suffer damage due to the processing in violation of the KVKK.

In accordance with Article 13 of the KVKK, to use your enumerated rights, you can send your request to Moodivation’s address below, with the information of your name, surname and signature, if you are a citizen of the Republic of Turkey your identity number, if you are not a citizen of the Republic of Turkey your nationality, passport number or identity number, if any, your place of residence or workplace address for notification, your notification e-mail address and telephone number, and the subject of the request and the necessary information and documents in written form to determine your identity or you can apply by e-mail to get general information on KVKK.

Your requests regarding your rights are concluded by Moodivation free of charge within 30 (thirty) days at the latest. However, if the transaction requires an additional cost, the fee in the tariff determined by the Personal Data Protection Board will be charged by the Company.

In terms of the processing of personal data, Mood Bilgi Teknolojileri A.Ş. is the data controller in accordance with the definition in the current legislation.
